From zero to 580 in three and a half years. That's the story of EB-5 regional center recovery following the program's March 2022 reauthorization.
The Redesignation Journey
When the Regional Center Program lapsed in June 2021, every single regional center lost its designation. More than 800 centers that had operated under the pre-RIA framework suddenly had no authorization. The March 2022 RIA reauthorization created a new designation process via Form I-956. Every regional center faced the same choice: reapply with updated business plans, compliance frameworks, and economic methodologies, or accept termination and exit the industry entirely.
What Changed: The New Framework
Post-RIA regional centers operate in a fundamentally different environment. The Form I-956 designation process carries a $17,795 filing fee, takes 6 to 12 months to process, and requires detailed business plans along with robust compliance frameworks. Once designated, centers can seek project-specific approval through Form I-956F, which pre-approves individual investment projects. This has become an essential marketing tool, since investors overwhelmingly prefer USCIS-approved structures. Centers must also submit detailed annual reports via Form I-956G, and failure to file can result in automatic termination. The financial burden extends further through the Integrity Fund fee, which runs approximately $20,000 to $25,000 annually. Non-payment triggers automatic termination after just 90 days, ensuring that only committed operators remain in the ecosystem.
How to Evaluate a Regional Center
With 580 centers operating, investor due diligence matters more than ever. The strongest indicators of a reliable regional center include a history of I-829 approvals, which represent the ultimate success metric—proof that prior investors received their permanent green cards. A strong capital deployment track record, verified job creation history, and consistent compliance with I-956G reporting requirements are all signs of a well-run operation. Conversely, certain warning signs should send investors running. Any center that promises guaranteed returns is misleading you—nothing in EB-5 is guaranteed. Pressure to invest quickly without adequate due diligence time, a lack of transparency about project financials, and no track record of completed projects are all serious red flags that warrant immediate caution.
