EB-5 Minimum Investment: Today's Amounts and the 2027 Inflation Adjustment

Last updated: October 21, 2026

The EB-5 minimum investment is $800,000 for a targeted employment area (TEA) or infrastructure project and $1,050,000 otherwise. By law, the amounts adjust for inflation on January 1, 2027, and every 5 years after. The adjustment applies to petitions filed on or after that date. The new amounts are expected; not yet announced.

Today's amounts

These are set in 8 U.S.C. 1153(b)(5)(C)(i) and (ii).

How the 2027 adjustment works

The EB-5 Reform and Integrity Act of 2022 added an automatic inflation adjustment. Here is what the law says:

The new amounts are expected; not yet announced. We will update this page when DHS publishes them.

Who is affected

The adjustment applies to EB-5 petitions (Form I-526 or Form I-526E) filed on or after the date it takes effect. It covers both the standard amount and the TEA amount.

Why the filing date matters

The law ties the new amounts to the filing date. It says the amount "shall automatically adjust for petitions filed on or after the effective date of each adjustment." The first adjustment begins January 1, 2027, and USCIS says it applies to petitions filed on or after that date. A petition filed before then is generally measured against today's amounts. If DHS publishes the new amounts after January 1, 2027, ask your immigration attorney how filings made in the meantime will be treated. How this applies to your case is a question for your immigration attorney.

I-526E timing

Regional center investors file Form I-526E. Two dates are in play:
